Under Louisiana law, assault is considered any attempt that puts another person in fear of having their person violently touched by an offender. This is considered simple assault and under the law offenders may be sentenced to up to 6 months in jail.

 

Aggravated assault is a much more serious crime, and is considered one that is committed with a dangerous weapon. While general aggravated assault convictions typically will result in six months in jail and fines of up to $1,000, if the assault is committed during a theft at a retail outlet, the mandatory minimum sentence could be as long as six months in jail as well as fines.
